Council of Bureaux (COB), organizația care coordonează sistemul Carte Verde, enumeră și state din afara SEE.

Corpul paginii — extras 1 · limba originalului: enCross-border road traffic accidents in the victim’s country of residence 1 What is the Green Card system? What is the Green Card system? What is the Green Card system? The Green Card system is a protection mechanism for victims of cross-border road traffic accidents caused by foreign vehicles. It facilitates the flow of cross-border road traffic in Europe and ensures the compensation of victims of accidents caused by foreign motorists by guaranteeing sufficient third party liability to the latter. The system consists of 47 member countries represented by 43 Green Card Bureaux. The Green Card system is conditioned upon the existence of: A Green Card Bureau – established in each participating country A valid Green Card – issued by a Green Card Bureau of one of the participating countries AIM OF THE SYSTEM = To enable a vehicle from country A to circulate in country B while being covered by the original MTPL insurance subscribed in country A 1 History History History The system was founded in 1949, stimulated by the United Nations Economic Commission for Europe and on the basis of Recommendation No. 5 adopted by the Working Party on Road Transport of the Inland Transport Committee. The initial twofold objective of the system was to facilitate: The crossing of borders = Motorists are released from the obligation of taking out a national insurance contract at the border of the 47 member countries if possessing a Green Card. The claims settlement = Victims of cross-border road traffic accidents should properly be compensated and not be prejudiced by the fact that the accident was caused by a foreign vehicle. 1 Members Members Members The Green Card system consists of 43 Green Card Bureaux representing about 1500 motor insurers in 47 countries in Europe, North Africa and the Middle East. The Member Bureaux are: List of Member Countries A - Austria (since 1954) AL - Albania (since 1992) AND - Andorra (since 1996) AZ - Azerbaijan (since 2016) B - Belgium (since 1949) BG - Bulgaria (since 1971) BIH - Bosnia and Herzegovina (since 1996) BY - Belarus (since 2003 - suspended) CH - Switzerland (since 1949) CY - Cyprus (since 1996) CZ - Czech Republic (since 1949) D - Germany (since 1951) DK - Denmark (since 1949) E - Spain (since 1953) EST - Estonia (since 1992) F - France (since 1949) FIN - Finland (since 1949) GR - Greece (since 1949) H - Hungary (since 1960) HR - Croatia (since 1992) I - Italy (since 1953) IR - Islamic Republic of Iran (since 1976 - suspended) IRL - Ireland (since 1949) IS - Iceland (since 1970) L - Luxembourg (since 1949) LT - Lithuania (since 2003) LV - Latvia (since 1998) M - Malta (since 1985) MA - Morocco (since 1969) MD - Moldova (since 1997) MK - North Macedonia (since 1994) MNE - Montenegro (since 2012) N - Norway (since 1949) NL - Netherlands (since 1949) P - Portugal (since 1953) PL - Poland (since 1958) RO - Romania (since 1965) RUS - Russia (since 2009 - suspended) S - Sweden (since 1949) SK - Slovak Republic (since 1949) SLO - Slovenia (since 1992) SRB - Serbia (since 1954) TN - Tunisia (since 1969) TR - Türkiye (since 1964) UA - Ukraine (since 1997) UK - United Kingdom (since 1949) 0 A Green Card Bureau is an organisation established in each country of the Green Card system, guaranteeing that a victim suffering damage from a road traffic accident caused by a foreign vehicle (from another participating country) will be compensated in the country of the accident. The Bureau of the country of the accident can, subsequently, recover all compensations paid from the Bureau of the country from which the liable vehicle originates. Each Green Card Bureau represents the motor liability insurers of its country. A Green Card Bureau has two functions: As a "Bureau of the country of the accident" (or handling Bureau), it has responsibility for the handling and settlement of claims arising from accidents caused by visiting vehicles. When compensating victims, the handling Bureau will apply the rules of insurance and liability law of the country of the accident.
Textul în documentul-sursă ↗Corpul paginii — extras 2 · limba originalului: enAs a Guaranteeing Bureau it guarantees certificates of Motor Insurance, Green Cards, which are issued by its member insurance companies to their policyholders. Green Card Bureaux cooperate on the basis of the Internal Regulations and operate with the recognition and approval of their governments. 1 Geographical scope Geographical scope Geographical scope The geographical scope of the Green Card System extends to: European countries lying to the West of the Ural Mountains and the Caspian Sea Countries bordering the Mediterranean Sea. Apart from the existing members of the Green Card System, the following countries are eligible for future COB Membership: Algeria, Armenia, Egypt, Georgia, Kazakhstan, Lebanon, Libya and Syria. Language = official language(s) of the issuing country + title of the document in English and French Format = horizontal or vertical (determined by the United Nations Economic Commission for Europe - UNECE) 1 Green Card Green Card Green Card The IMIC (International Motor Insurance Certificate), also known as the Green Card, is an international certificate of insurance accepted without any obstacle or cost by the authorities of all 47 countries of the Green Card system. A Green Card can be delivered by a Bureau, an insurance undertaking or an insurance intermediary, but it is always issued under the authority of a Green Card Bureau. It certifies that a visiting vehicle has at least the minimum compulsory Motor Third Party Liability Insurance cover as required by the law of the country visited. It provides a guarantee for the visited country that the insurer of the vehicle's country of origin will reimburse the victim's damage in accordance with the rules applicable in the visited country. In this way, the victim of an accident caused by a foreign vehicle is properly compensated for the damage suffered. 1 Correspondents Correspondents Correspondents According to the rules of the Green Card System, the Bureau of the country of the accident is competent to receive and handle claims addressed by victims having suffered an accident caused by a foreign vehicle (originating from another participating country). However, the Green Card System also allows motor insurers to nominate correspondents in other participating countries. This correspondent will then be responsible to handle all claims arising from accidents occurred in the country where the correspondent is nominated and caused by (foreign) vehicles insured by the (foreign) motor insurer that has nominated the correspondent. The correspondent acts in the name of the Green Card Bureau of the country where the correspondent is nominated and for the account of the foreign insurer that has nominated the correspondent. The nomination of correspondents is a possibility for insurers, not an obligation. The Green Card Bureau of the country of the accident will guarantee the quality of the claims handling process by the correspondent and the Bureau continues to bear the final responsibility for the compensation of the damage caused. Each Bureau must establish and publish the conditions under which the Bureau grants, refuses or withdraws the approval of correspondents. In that context the COB agreed on the use by the Bureaux of the 3 following documents: The model for a Correspondents’ Charter, The Handling and Paying Model Agreement , The Rules on Outsourcing. 1 Multilateral Agreement Multilateral Agreement Multilateral Agreement The introduction of the Green Card system was an important contribution to facilitate international traffic. Nevertheless, showing a document at each border is still time-consuming and creates obstacles to the free movement of persons and goods. For this reason, encouraged by European initiatives, several Green Card member countries replaced the Green Card by the Multilateral Agreement (MA). Today, 36 of the 47 countries participating in the Green Card system apply the Multilateral Agreement: The 27 Member States of the European Union;
Textul în documentul-sursă ↗Corpul paginii — extras 3 · limba originalului: en3 additional European countries participating to the European Economic Area: Iceland , Liechtenstein and Norway ; 6 additional countries participating to this system by way of agreement: Andorra , Bosnia and Herzegovina , Montenegro , Serbia , Switzerland and the United Kingdom . The MA Signatory Bureaux recognise each other’s MTPL insurance on the basis of the origin of the vehicle (based on the notion of ‘ territory in which a vehicle is normally based ’, as described in article 1.4 of the Codified Directive) . Consequently, the Green Card is no longer a required document when crossing the borders for motorists from those countries! NOTE : in some countries, the Green Card is more than only an international proof of insurance. Certain countries have turned the Green Card into a national proof of insurance, on the basis of national legislation. Despite what is explained above, it might therefore still be necessary to have a Green Card, but not for travelling internationally.

PDF p. 6Motor Insurance Framework Participation in the Green Card-free Circulation Zone (GCFCZ) The UK lost automatic membership of the Green Card Free Circulation Zone established by the Directive as a result of Brexit. However the UK again became a member: on 30 June 2021 the European Commission issued Implementing Decision (EU) 2021/1145 which stated that with effect from 2 August 2021 Member States shall refrain from making checks of insurance against civil liability in respect of all types of vehicles normally based in the United Kingdom except for military vehicles registered therein, at their entry in the Union. This in effect confirmed the UK’s re-admittance to the Green Card Free Circulation Zone meaning that UK motorists have not needed to carry a Green Card from 2 August 2021 in the EU/EEA. Protection of Visiting Victims The UK lost access to the Visiting Victims system established under the Motor Insurance Directive. Compensation is still available to UK residents. The National Insurance Bureaux, who are signatories to the multilateral agreement that guarantees compensation for visiting victims, have agreed to continue their multilateral cooperation and will continue handling claims based on deemed insurance cover. Insurers of foreign drivers are no longer required to establish a claims representative in the UK and DfT has removed the compensation body obligations on MIB from UK legislation, as without this the MIB would have to pay out where a UK resident incurred damages by a foreign driver in the EU/EEA but the foreign compensation body wouldn't be obliged to reimburse MIB. This means that if a UK resident is injured by an insured vehicle in the EU/EEA, the individual would need to pursue a claim against the insurer in the foreign country, rather than through a UK-based claims representative. The MIB has said that they could still assist victims before they make a claim to get information in their language. There are no legislative requirements arising from this and the MIB acts for the whole UK so no separate arrangements are required for NI. For uninsured/untraced vehicles, the MIB has negotiated bilateral ‘Protection of Visitors’ agreements with the guarantee funds of EU/EEA countries so victims will still be able to claim compensation, but this would be done through the Guarantee Fund of the foreign country rather than the MIB Bilateral agreements have been agreed with all EU countries except for Romania, who have agreed in principle but are yet to make the requisite domestic legislation. This Common Framework will be an agreement between DfT and DfI. International obligations The international obligations that apply to this area are: • The Inter-Bureaux Uniform Agreement between all bureaux participating in the Green Card scheme (first signed in 1951 in support of a United Nations initiative).

Hit by a foreign vehicle in the UK? If you’re in an accident in the UK, the British Crown Dependencies or Gibraltar with a foreign-registered vehicle, you may be able to make a claim. 1 Collect as many details as you can You’ll need to collect as many details as you can about the foreign vehicle involved in the accident. You should do this no matter who is at fault. Make sure you get: Name and address Vehicle registration number, make and model Registration of the cab (if accident is with a lorry) Insurance information Photos of both vehicles and the surrounding area Witness contact details 2 Ask the other driver if they know their Green Card number When you swap your insurance details at the accident scene, ask if the driver knows their Green Card number. This is an internationally recognised document that will help you and your insurer identify the right details ready to make a claim. If they don’t know it, just make sure you take note of their vehicle registration number instead. 3 Contact your insurer If the accident involved a vehicle that you were driving, the next step is to contact your insurer. They’ll be able to give you guidance on what to do next. 4 Find the foreign insurer’s UK representative Because the accident happened in your own country, your claim can only be processed and settled locally. This is why all foreign insurers have a legal in-country representative that you can submit a claim against. Our Find a foreign insurer’s UK representative service below can help you identify the correct representative if the information you have from the other driver is unclear or incomplete. We’ll use this information to consult with other countries and try to locate the insurer and/or their UK representative. Please note, for this to be successful, you’ll need to know the vehicle’s registration number. Start a new claim Frequently asked questions about having an accident with a foreign vehicle in the UK Why do I need to find a UK representative if I have the foreign insurer’s details? For legal reasons, claims made on behalf of a resident of the UK, British Crown Dependencies and Gibraltar can only be submitted and resolved in-country. Most foreign insurers have authorised an organisation or local branch to act on their behalf to make sure that all outcomes of a case are compliant under UK law. Sometimes, the representative of the foreign insurer may be MIB. The same is reversed in other countries – if you have an accident abroad, your UK or home territory insurer may have a representative within the country where the accident took place. MIB is the in-country representative. What should I do now?

Corpul paginii — extras 1 · limba originalului: enInsurance and accident advice for driving abroad Make sure you’re properly insured to drive abroad and know what to do if you’re involved in an accident or collision while you’re away. Driving abroad: what you need to know Driving in other countries can be a great experience, but rules and insurance requirements vary from country to country. Before you travel, it’s important to understand what level of insurance cover you have, what proof of insurance you may need, and whether additional cover is required. A few simple checks can help you avoid unexpected issues and make sure you’re legally covered wherever you drive. What is a Green Card for driving? The Green Card system , co-ordinated by COB , is an international initiative with 50 member countries that aims to protect road users by making sure that victims of accidents caused by foreign vehicles receive fair compensation. It does this through the use of a Green Card, which is a document that proves your vehicle has valid motor insurance when driving in member countries. A Green Card shows that your insurer will provide you, at minimum, with the level of insurance cover required by law in the country you’re visiting. This is usually part of your UK-based insurance policy and does not cost you anything extra. The minimum insurance cover required by law is usually on a third-party basis. Third-party only covers damage you’ve caused to other people or vehicles if you’re the driver at fault. If you’re planning to drive abroad, we’d recommend you check this with your insurer and pay for additional cover before you go if you feel you need it. Do you need a Green Card to drive abroad? A Green Card is only relevant when you are driving a UK, British Crown Dependencies or Gibraltar-registered car abroad. The Green Card system is split into two categories. Free circulation zone You don’t need to carry or display a Green Card if you’re driving within the free circulation zone. Your UK motor insurance automatically provides the minimum level of cover needed. Countries included in the free circulation zone: All countries within the European Economic Area (EEA) UK, British Crown Dependencies and Gibraltar Andorra Bosnia and Herzegovina Montenegro Serbia Switzerland If you’re planning to drive in these countries, it’s advisable to contact your insurer to arrange comprehensive insurance cover so that costs for theft or damage to your own vehicle and personal injury are included, should you have an accident. Proof of Green Card needed Some countries do require a Green Card to be shown as proof of motor insurance. You’ll need to request this from your insurer before you travel. They are usually issued digitally and can be shown on your phone. Countries that require proof of a Green Card: Albania Azerbaijan Moldova North Macedonia Tunisia Turkey Ukraine When you request a Green Card, make sure to check the level of insurance cover. Consider upgrading to comprehensive insurance for the duration of your time abroad. We always recommend you carry a printed copy of your Green Card with you just in case. What if my insurer won't issue a Green Card? In some cases, your UK insurer may decline your request to cover your travel to one of the countries that require proof of a Green Card. If this happens, you’ll need to pay a different insurer who is willing to cover you for the duration of time you are spending in that country. This temporary policy will just run alongside your usual UK insurance, starting as you enter the specific country and ending when you leave again. Driving in countries outside the Green Card system If you’re planning to drive your own car in countries that aren’t part of the Green Card system, you’ll need to purchase local insurance at the border. This is known as frontier insurance and provides country-specific cover for your trip.
Textul în documentul-sursă ↗Corpul paginii — extras 2 · limba originalului: enYou’re no longer covered by your usual insurer under these circumstances, which means that any accidents in these countries will need to be resolved through the frontier insurance company that issued you with the policy. Green Card system members change from time-to-time. It’s worth checking the status of the country you are travelling to if it’s outside of the EEA. COB , the organisation that co-ordinates the Green Card system, have an interactive map that shows the live status of every country. View the COB map What happens if you have an accident abroad? At the scene Collect as many details as you can Whether you’re in a vehicle, on a bike, or a pedestrian, you’ll need to collect as many details as you can about the other vehicle involved in the accident. You should do this no matter who is at fault. Make sure you get: Name and address Vehicle registration plate, make and model Insurance and/or Green Card information Photos of both vehicles and the surrounding area Witness contact details What to do next Report it to the police Either you or the other driver should report the accident to the police. It may even be helpful for your insurance claim if you can get a copy of the police report. What to do next Contact your insurer If the accident involved a vehicle that you were driving, the next step is to contact your insurer. They’ll be able to give you guidance on what to do next. Standard accident form In many European countries, drivers use a standard accident form called a ‘Constat Amiable’. This form helps the driver to record what happened in the accident using simple diagrams and details from both drivers. Insurers will use this to decide who was responsible for the accident. The form has space for a signature at the bottom, but you should think carefully before signing. Only sign it if you fully understand what it says and if you agree with all of the information written. Signing a form with inaccurate information could cause issues for your insurance claim. You are not obligated to sign the form, even if the other driver wants you to. Locating a foreign driver Struggling to get a driver’s details after an accident abroad? The UK Information Centre run by MIB may be able to help you with finding the insurance details of the foreign vehicle involved. You can contact us via email at UKICInfoCentre@mib.org.uk . Did you know? Accidents involving lorries European heavy goods vehicles (HGVs) have different registration numbers on the cab and the trailer If you have an accident with a lorry, you’ll need to make sure you get the insurance policy information for the cab (sometimes called the tractor unit). Frequently asked questions about driving abroad or having an accident with a foreign vehicle Do I need a Green Card to drive abroad? A Green Card is a document that acts as proof of insurance for the vehicle you’re driving abroad. If you’re driving in what is known as the free circulation zone, then you won’t need physical proof of a Green Card. If you’re driving beyond the free circulation zone, you may need to request a Green Card from your usual insurer. This is only necessary for the following countries: Albania Azerbaijan Moldova North Macedonia Tunisia Turkey Ukraine If you’re driving outside of the Green Card system entirely, you’ll need to buy frontier insurance at the border of the country you’re visiting. Examples include Algeria, Egypt and Syria. This also applies to countries that are suspended from the Green Card system. The Green Card system does not apply to locally hired cars in the country you are visiting. What happens if I don’t have a Green Card for the country I want to drive in? You can drive across most of Europe without needing to show a Green Card at the border. However, there are seven member countries that do require physical proof of motor insurance: Albania Azerbaijan Moldova North Macedonia Tunisia Turkey Ukraine

Textul în documentul-sursă ↗Corpul paginii — extras 2 · limba originalului: enAs a Guaranteeing Bureau it guarantees certificates of Motor Insurance, Green Cards, which are issued by its member insurance companies to their policyholders. Green Card Bureaux cooperate on the basis of the Internal Regulations and operate with the recognition and approval of their governments. 1 Geographical scope Geographical scope Geographical scope The geographical scope of the Green Card System extends to: European countries lying to the West of the Ural Mountains and the Caspian Sea Countries bordering the Mediterranean Sea. Apart from the existing members of the Green Card System, the following countries are eligible for future COB Membership: Algeria, Armenia, Egypt, Georgia, Kazakhstan, Lebanon, Libya and Syria. Language = official language(s) of the issuing country + title of the document in English and French Format = horizontal or vertical (determined by the United Nations Economic Commission for Europe - UNECE) 1 Green Card Green Card Green Card The IMIC (International Motor Insurance Certificate), also known as the Green Card, is an international certificate of insurance accepted without any obstacle or cost by the authorities of all 47 countries of the Green Card system. A Green Card can be delivered by a Bureau, an insurance undertaking or an insurance intermediary, but it is always issued under the authority of a Green Card Bureau. It certifies that a visiting vehicle has at least the minimum compulsory Motor Third Party Liability Insurance cover as required by the law of the country visited. It provides a guarantee for the visited country that the insurer of the vehicle's country of origin will reimburse the victim's damage in accordance with the rules applicable in the visited country. In this way, the victim of an accident caused by a foreign vehicle is properly compensated for the damage suffered. 1 Correspondents Correspondents Correspondents According to the rules of the Green Card System, the Bureau of the country of the accident is competent to receive and handle claims addressed by victims having suffered an accident caused by a foreign vehicle (originating from another participating country). However, the Green Card System also allows motor insurers to nominate correspondents in other participating countries. This correspondent will then be responsible to handle all claims arising from accidents occurred in the country where the correspondent is nominated and caused by (foreign) vehicles insured by the (foreign) motor insurer that has nominated the correspondent. The correspondent acts in the name of the Green Card Bureau of the country where the correspondent is nominated and for the account of the foreign insurer that has nominated the correspondent. The nomination of correspondents is a possibility for insurers, not an obligation. The Green Card Bureau of the country of the accident will guarantee the quality of the claims handling process by the correspondent and the Bureau continues to bear the final responsibility for the compensation of the damage caused. Each Bureau must establish and publish the conditions under which the Bureau grants, refuses or withdraws the approval of correspondents. In that context the COB agreed on the use by the Bureaux of the 3 following documents: The model for a Correspondents’ Charter, The Handling and Paying Model Agreement , The Rules on Outsourcing. 1 Multilateral Agreement Multilateral Agreement Multilateral Agreement The introduction of the Green Card system was an important contribution to facilitate international traffic. Nevertheless, showing a document at each border is still time-consuming and creates obstacles to the free movement of persons and goods. For this reason, encouraged by European initiatives, several Green Card member countries replaced the Green Card by the Multilateral Agreement (MA). Today, 36 of the 47 countries participating in the Green Card system apply the Multilateral Agreement: The 27 Member States of the European Union;

Each Member State shall establish or approve a compensation body responsible for providing compensation to injured parties in the cases referred to in Article 20(1). Such injured parties may present a claim to the compensation body in their Member State of residence: (a) if, within three months of the date when the injured party presented his claim for compensation to the insurance undertaking of the vehicle the use of which caused the accident or to its claims representative, the insurance undertaking or its claims representative has not provided a reasoned reply to the points made in the claim; or (b) if the insurance undertaking has failed to appoint a claims representative in the Member State of residence of the injured party in accordance with Article 20(1); in such a case, injured parties may not present a claim to the compensation body if they have presented a claim for compensation directly to the insurance undertaking of the vehicle the use of which caused the accident and if they have received a reasoned reply within three months of presenting the claim. Injured parties may not however present a claim to the compensation body if they have taken legal action directly against the insurance undertaking. The compensation body shall take action within two months of the date when the injured party presents a claim for compensation to it but shall terminate its action if the insurance undertaking, or its claims representative, subsequently makes a reasoned reply to the claim. The compensation body shall immediately inform: (a) the insurance undertaking of the vehicle the use of which caused the accident or the claims representative; (b) the compensation body in the Member State in which the insurance undertaking which issued the policy is established; (c) if known, the person who caused the accident; that it has received a claim from the injured party and that it will respond to that claim within two months of the presentation of that claim. However, Member States may not allow the body to make the payment of compensation subject to any conditions other than those laid down in this Directive, in particular the injured party’s establishing in any way that the person liable is unable or refuses to pay. 2. The compensation body which has compensated the injured party in his Member State of residence shall be entitled to claim reimbursement of the sum paid by way of compensation from the compensation body in the Member State in which the insurance undertaking which issued the policy is established.

You’ll need to exchange insurance policy and personal details, take photos of the vehicles involved, and contact your insurer as soon as you can. If the other driver is at fault, you’re struggling to get their details, or they’ve left the accident scene, you can contact MIB for guidance on next steps.
